BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE NOTICE BY L.G. EVERIST, INC. OF A FIRST <br /> PERIOD OF TEMPORARY CESSATION, File No. M-1988-048 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") as a <br /> consent item on October 18, 2023, to consider the notice of a first period of temporary <br /> cessation filed by L.G. Everist, Inc. ("Operator"), file number M-1988-048. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c) reclamation permit for a sand and gravel <br /> operation. The site is known as the Carr Gravel Resource. The site is located in <br /> Weld County, Township 11 North, Range 67 West, Section 26, 6th Principal <br /> Meridian. <br /> 2. On July 18, 2021, Operator submitted to the Division a notice for the <br /> first period of Temporary Cessation for the site. The notice stated that mining <br /> operations were temporarily ceasing due to a lack of market demand. <br /> 3. Operator requested an effective date of July 18, 2023, for this period of <br /> temporary cessation. <br /> 4. Operator has committed to comply with all reclamation requirements <br /> or other activities related to applicable performance standards while the mine is in <br /> temporary cessation. <br /> 5. The financial warranty is adequate to cover current reclamation. <br /> 6. The Division has identified no performance standard issues in the <br /> notice or through an inspection of the file for the site. <br /> 7. Division provided notice to all interested parties of Operator's notice, <br /> and no interested parties objected to or expressed concerns with the notice. <br />
