<br /> <br />RN17-05 1-5 Revised 11/17 <br /> <br />handle approximately 2,000,000 tons of coal per year. The unloading system approved by CDMG <br />under TR-06 (June 2005) included the following components: <br /> <br />• An unloading hopper to unload rail cars <br /> <br />• A 60-inch reclaim conveyor, housed in an inclined concrete tunnel to transport <br />coal (4,000 tph) from the unloading hopper to a rubber-tired radial stacker <br /> <br />• The radial stacked will feed a 30-foot high, 30,000 ton coal stockpile <br /> <br />• A tracked dozer will move the coal from the stockpile to the existing truck-dump <br />hopper <br /> <br />• The existing truck dump reclaim conveyor will move coal (1,500 tph) through the <br />existing crusher building to a loadout conveyor (existing conveyor relocated) to <br />the loadout building (re-locate and modify existing) <br /> <br />As part of the approved plan the existing crusher building will be refurbished and the crusher will be <br />removed and replaced by a coal chute. In addition, the loadout conveyor will be refurbished and <br />relocated from the existing stack tube reclaim tunnel to the crusher building. The loadout conveyor <br />will then be used to elevate coal from the crusher building to the top of the re-furbished and relocated <br />loadout structure. Haulroad HGLF-HR2, which was previously permitted as part of the original C- <br />92-081 permit package, will be re-aligned and re-constructed as a dedicated haulroad. <br /> <br />Consequently, the Hayden Gulch Loadout, in its current physical and regulatory state, is permitted <br />as a dual-purpose facility. Under the original facility plan, approved by CDMG with the original C- <br />92-081 permit application package, and which is still part of the permit application package (see <br />Attachment 12-1), HGTI is approved to loadout coal via railcar for shipment to market. The railcar <br />unloading plan, which is permitted under TR-06, allows HGTI to change the operations at the <br />facility if warranted by market conditions (e.g., if Routt County suddenly prohibited truck haulage <br />from the Foidel Creek Mine to the Hayden Station over Routt County Road 27) to facilitate either <br />railcar loading or unloading and loading of trucks from a stockpile. <br /> <br />Tab 23 of the PAP presents the reclamation liability estimate. The liability estimate for TR-06 (the <br />railcar unloading plan) is $1,083,800. HGTI calculated that the railcar loadout plan liability (original <br />operation and the on-the-ground condition) at $916,090. Consequently, there are reclamation bonds <br />in place for either operational alternative. <br /> <br />Because of the inactivity at the facility and uncertainty with regards to the future use (i.e., railcar <br />loadout, railcar load-in or both), HGTI reaffirmed with CDMG that the Hayden Gulch Loadout <br />permit was in temporary cessation in correspondence dated August 30, 2005. With a corporate <br />decision to not pursue development of the reserves to the south, HGTI initiated reclamation activites <br />in 2011, removed the surface facilities associated with the coal handling operations, and backfilled <br />and regraded the facilities area. On February 2, 2012 HGL submitted a partial Phase I Bond <br />Release application for an 11.9 acre portion of the total 202.1 acre disturbed area where the <br />loadout facilities were located. The decision to approve was issued on July 27, 2012 and reduced <br />the reclamation bond liability to $1,203,940. The facility returned to temporary cessation status <br />following the 2011 reclamation activities, and remained inactive until July of 2016, when HGTI <br />initiated a second phase of reclamation, removing the rail, ties, and ballast from the rail spur. <br />As a result on these ongoing activities, and in
