/\ ` MineWater <br /> W <br /> water is very broadly decreed and can be used and re-used which will help with road <br /> construction and repairs, and for any other water needs throughout the County. <br /> 4. MineWater has increased the available flow from the London Mine developed water rights by <br /> 600 acre-feet per year which has substantially improved the quality and quantity of water in <br /> Mosquito Creek since 2017,and improved the fishing along the creek by more than double the <br /> pre-cleanup numbers. MineWater agrees to continue to provide this increased flow in the creek, <br /> during the term of our mine cleanup efforts. <br /> 5. Beginning in June 2024, MineWater agrees to allow public access(either through open gate <br /> access,or through a manned/automated QR code scanned access to provide warning to the <br /> operators of visitors passing through), limited to County Road 696, along the London Mine <br /> Access Road (from the black gate to American Flats)-on-weekends starting at Noon-Friday to <br /> sunset Sunday.To include Labor Day. Memorial Day,0 of July weekends. If additional weekend <br /> work causes a closure of the road,48-hour notice will be given to the county that the gate will <br /> be closed for such weekend work(i.e. haul trucks, dozer,excavator,etc.)which would create a <br /> safety concern. During the periods of Gate closures, MineWater will allow public parking in <br /> posted area for National Forest access only. If the gate is blocked there will be a sign posted <br /> warning that vehicles may be towed at owner's expense. <br /> 6. MineWater agrees to sell clean,sorted aggregate to the County at competitive market rates as <br /> such product becomes available through the remediation of the Mine. <br /> 7. MineWater will continue to provide an agreement for access along County Road 696 on the <br /> London Mine to the Town of Fairplay for the operation of the Burro Days Races on one weekend <br /> each year,and will extend that agreement for an additional 10 years at nominal cost to the <br /> Town. <br /> MineWater Requests of Park County: <br /> 1. Agreement by Park County that MineWater is financially responsible for any damage to the <br /> roads where we will operate, including County Road 696 and County Road 12 to Highway that <br /> may result from MineWater's project activities(execution of a modified Structures <br /> Indemnification Agreement); <br /> 2. MineWater has approval to haul material on-site,on the existing roads at the Site,to the Sorting <br /> facility for cleanup operations. Park County will support MineWater to perform road <br /> improvements(e.g.culvert crossing at the Hock Hocking Mine)as needed throughout this <br /> project and fully in accordance to County Standards and Specifications. <br /> 3. Park County agrees that the existing water treatment support facilities can remain that are <br /> located on-site per the attached location map so long that it is operated within the necessary <br /> state and federal permits. <br /> 4. Any future amendments to this agreement will be signed in acknowledgement by both parties. <br />
