Dear Mr. Russell,
Representatives from MW Sorter(M ineWater)have carefully reviewed your Adequacy Review Letter dated
October 6,2023 and wish to submit the following updated Exhibits with additional information to address
any concerns or add requested details to the previously submitted 110d package. Our response is
identified with bold lettering.
General Application Procedures
1. As required by Rule 1.6.2(1)(g),please submit proof of publication of a public notice in a
newspaper of general circulation in the locality of the proposed mining operation.
Applicant submits proof of publication of a public notice in a newspaper of general circulation
in the locality of the proposed mining operation,which was submitted for publication on the 8
and 15 of September in the Flume in Fairplay.

2. As required by Rule 1.6.2(1)(g),Applicant submits attached proof that the public notice was
provided to all owners of record of surface and mineral rights of the affected land and to the
owners of record of all land surface within 200 feet of the boundary of the affected land. Proof of
notice may be return receipts of a certified mailing or by proof of personal service.
Notice was acknowledged by the US Forest Service(Mr.Josh Voorhis) by email. Please see
attached.pdf titled,"Appendix B—Owner Acknowledgement FS".
Owner signatures were collected from Christian Anders(20%owner of the American Mine
Parcel),and by Erik and Beth Swanson who own 20%and 10%,respectively of the American
Mine Parcel.Timely notice is also acknowledged by MineWater Finance LLC,and by MW Sorter
LLC,who own the remaining land interests and whose LLC Manager has executed a receipt of
notice acknowledgement. Please see attached .pdf titled,"Appendix C—Owner
Acknowledgement Other".
3. The Division received comment letters from Colorado Parks and Wildlife and History Colorado
regarding the application. The letters are attached for your review. Please acknowledge and
address any comments noted in the letters and make changes to the application as necessary.
Applicant understands CPW concerns and agrees that if 10 or more bighorn sheep are present
within the permit area,Applicant will make sure that sources of machinery/engine noise shall
