COLORADO
cs
a a Division of Water Resources
® Department of Natural Resources
Response to Consideration of 110C Construction Materials Amendment Application
DATE: October 12, 2023
TO: Elliott R Russell, Environmental Protection Specialist
FROM: Kate Fuller, Water Resources Engineer
RE: Glen Johnston Site 1, Permit No. M-1982-044-AM-2
Applicant/Operator: Craig Pester; 402-499-0344
SE'/a SE'/a, Section 33, Twp. 12 South, Rng. 69 West, 6th P.M.
Water Division 1, Water District 8, Teller County
CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of
groundwater must not occur during or after mining operations.
® The applicant will need to document that any water used at the site was obtained from a legal
source and be able to provide such documentation to this office upon request.
® Any stormwater runoff intercepted by this operation that is not diverted or captured in priority
must infiltrate into the ground or be released to the stream system within 72 hours; otherwise the
operator will need to make replacements for evaporation.
COMMENTS: The subject application is to increase the area of a surface mining operation from 7.0
permitted acres to 9.9 acres located 3 miles west of Divide, Colorado. The primary commodity to be
mined at the site is gravel-aggregate. The site is proposed to be reclaimed for storage of equipment and
agricultural related buildings. It may be later developed for commercial or residential use.
Mined material is anticipated to be excavated to a depth of approximately 30 feet. It is not anticipated
that groundwater will be encountered during mining activities. The static water level of a well in the
vicinity ranges was measured at 48 feet below ground surface and the nearest intermittent stream is
further from the site, which supports the applicant's belief that groundwater will not be encountered at a
mining depth of 30 feet.
The reclamation plan for the site includes leveling the area and reseeding.
The applicant did not identify any use of water at the site. If water is needed for dust control or other
purposes at the site, it must be obtained from a legal source permitted or decreed for such industrial use.
The applicant did not identify how stormwater falling on the site will be managed. Should stormwater be
intercepted by this operation and not infiltrate into the ground or otherwise be released to the stream
system within 72 hours, the operator will need to make replacements for evaporation through a substitute
water supply plan approved by this office or a plan for augmentation decreed by the water court.
The Division of Reclamation Mining St Safety and/or the applicant may contact the State Engineer's Office
with any questions.
- CO'0
1313 Sherrtarr Strut, Room 921, d rlv r, CO 80203 P 301-8h6_3591 hLLys:rldwr_LD[Dri3do.1Zav
Jrd 5_ Polis,Governor I fan Gibad, Exeeuliv ireCLor It,vin_ Itin, 5Lale Lnsitecr r Uire[Lor
f 1876 i
