COLORADO
cs
a a Division of Water Resources
® Department of Natural Resources
Response to Consideration of 112 Construction Materials Reclamation Permit Application
DATE: October 10, 2023
TO: Nickie Gagnon, Environmental Protection Specialist
FROM: Kate Fuller, Water Resources Engineer
RE: MAW Partnership Gravel Pit, Permit No. M-2006-042
Applicant/Operator: Mark Kokes; 970-467-7780
S'/z NW'/a, Section 34, Twp. 12 North, Rng. 49 West, 6th P.M.
Water Division 1, Water District 64, Logan County
CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of
groundwater must not occur during or after mining operations.
® The applicant will need to document that any water used at the site was obtained from a legal
source and be able to provide such documentation to this office upon request.
® Any stormwater runoff intercepted by this operation that is not diverted or captured in priority
must infiltrate into the ground or be released to the stream system within 72 hours; otherwise the
operator will need to make replacements for evaporation.
COMMENTS: The subject application is to expand the area of a surface mining operation from 27.8
permitted acres to 59.2 acres located nine miles north of Crook, Colorado. The primary commodity to be
mined at the site is road and construction base material. The site is proposed to be reclaimed to its
pre-mining use of pastureland upon completion of mining operations.
It is not anticipated that groundwater will be encountered during mining activities.
The reclamation plan for the site includes replacing topsoil and grading as needed. It is anticipated that
the site will revegetate naturally.
If water is needed for dust control or other purposes at the site, it must be obtained from a legal source
permitted or decreed for such industrial use.
The applicant did not identify how stormwater falling on the site will be managed. Should stormwater be
intercepted by this operation and not infiltrate into the ground or otherwise be released to the stream
system within 72 hours, the operator will need to make replacements for evaporation through a substitute
water supply plan approved by this office or a plan for augmentation decreed by the water court.
The Division of Reclamation Mining St Safety and/or the applicant may contact the State Engineer's Office
with any questions.
- CO'0
1313 Sherrtarr Strut, Room 921, d rlv r, CO 80203 P 301-8h6_3591 hLLys:rldwr_LD[Dri3do.1Zav
Jrd 5_ Polis,Governor I fan Gibad, Exeeuliv ireCLor It,vin_ Itin, 5Lale Lnsitecr r Uire[Lor
f 1876 i
