Fiddler's Green Circle, Suite 1000 <br /> Greenwood Village, CO 80111 <br /> 303-796-2626 <br /> sclark(a)bfwlaw.com <br /> RE: Response to April 6, 2023 Letter: <br /> Objection and Protest <br /> CJK Milling Company, LLC <br /> M1990-057 <br /> Mr. Clark and Concerned Citizens, <br /> Union Milling Company (UMC) - holder of CDRMS Permit M1990-057 (Leadville Mill) — has <br /> prepared responses to CC41-C's objections to the proposed Mill permit application. The below <br /> responses will be included in the comprehensive response document that will be submitted to <br /> CDRMS. <br /> Materials Handling <br /> • Cyanide is a very dangerous chemical and should not be used so close to residential <br /> properties nor near water sources such as wells and the Arkansas River. <br /> • Only two (2) sites remain in Colorado that use cyanide in their operations and neither exist <br /> anywhere near residential properties. Instead, they operate in remote and extremely <br /> isolated areas far from areas where people live, work, and recreate. CC4LC thinks this is <br /> a much safer approach for such facilities. Yet CJK insists that they should be allowed to <br /> use such chemicals in the backyard of near-by residences. The Cyanide Emergency <br /> Response Plan deals mostly with risks to employees, but how long does cyanide stay in <br /> the air, and how quickly does it travel? If such a spill occurred, would the three closest <br /> residences be impacted? Would a wider area be impacted? Would we discover this had <br /> occurred because a pet is dead, and the residents may be experiencing symptoms such <br /> as described in this plan? <br /> Cyanide <br /> CJK is also concerned about the environment, and like all modern natural resource operations <br /> will take great care to protect it. This will be accomplished in the following steps: <br /> Step 1: Plant Design and Operation <br /> CJK has relied on engineers and consultants with extensive experience in the design and <br /> operation of the process facility. Further, CJK acknowledges and agrees with those concerned <br /> that experienced managers are requisite for a safe and efficient operation. <br />
