Craig Gooch <br /> 415 Alpine Cirque <br /> Leadville, CO 80461 <br /> craig.gooch gmail.com <br /> RE: Objection to Proposed Amendment to the Leadville Mill Permit M1990-057 <br /> Mr. Gooch, <br /> Thank you for taking the time to express the objections/concerns to our proposed amendment to our <br /> Leadville Mill permit. <br /> Objection: 1 object to this application due to the significant negative impacts on the local environment, <br /> traffic, economy, tourism, and general character of the unique Leadville area. Specific impacts that are not <br /> fully analyzed or mitigated by this project include: <br /> - sound I vibration <br /> - air quality <br /> - water quality <br /> - water quantity <br /> - visual aesthetics <br /> - Night light pollution <br /> - Traffic <br /> - Animal impacts <br /> - Ecosystem impacts <br /> - Impacts on existing transportation and recreation <br /> - Property value <br /> - Business impacts <br /> - Sensitive sites-mineral belt, schools, community field, <br /> The impacts of this project are so significant that this project should require a reclamation bond in the event <br /> the project owner goes out of business. The bond would cover mitigation of environmental impacts and <br /> restore the site to appropriate conditions consistent with community needs. <br /> Following is our response. <br /> CJK's operating plan supports environmental reclamation. Initially, material to be treated is that which was <br /> mined in the late 19th and early 20th centuries and deposited on the surface as waste. This material still <br /> exists on the surface throughout the historic California District and other mining districts in Lake County and <br /> remains an active part (Operable Unit 6) of EPA's California Gulch Superfund site. Surface run-off from <br /> these dumps contribute to acid drainage in surface waters. Placement of this material in a properly <br /> designed containment facility will reduce this acid-metal laden load to the environment and is an approved <br /> remediation by EPA. <br /> The material also contributes to the contaminated groundwater within the Leadville Area. <br /> CJK will be moving mine dump acid generating material located within a potentially contaminated <br /> groundwater plume to a lined facility that results in a net overall benefit to the environment and specifically <br /> to improving water quality. <br /> Many of your concerns are regulated/managed by the County. As such they may not be specifically <br /> addressed in the CDRMS permit, but will be addressed at the County level under the required Conditional <br /> Use Permit(CUP)which cannot be submitted until the State Reclamation Permit is approved. The below <br /> responses to your concerns therefore may change. Please keep in mind that all residents will also have <br /> the opportunity to voice their concerns in public during the CUP process. <br /> • Sound I Vibration <br /> Leadville ordinance mandates 75dba at the property line. The process design addresses this requirement. <br /> The crusher will be the primary contributor to vibration. However, the crusher is small and calculations <br /> show that vibrations will be imperceptible and no threat to structures or public well-being. CJK is in the <br /> process of installing noise,dust and vibration monitors on the facility property near the neighboring homes. <br />
