8/31/23,5:54 PM MineWater LLC Mail-Fwd: Notice of Application Consideration for Permit:M2023015
water treatment activities at the Site, including maintaining roads with heavy equipment for delivery of
chemicals, maintenance of power and pumping equipment, monitoring and site inspections.
As part of the Consent Order, we have worked since 2016 with CPW and CDPHE for development of
appropriate standards for water quality, and we have dramatically improved water quality in Mosquito
Creek, South Mosquito Creek and No Name Creek through our ongoing efforts.
We understand that both Bighorn Sheep and Elk habitat is in the vicinity of our Project. We would like to
work out a stipulation or project commitment that we will reduce our operations to a minimum necessary
area of activity during the times that you have identified, so that the extent of our haulage activities will be
reduced areally to a minimum necessary to the furtherance of the project.
The water treatment operations will continue, and the x-ray sorting operation will continue, but the
haulage and stockpiling of feed material from the South London Stockpile will be minimized to the
greatest extent possible only to maintain minimal feed rates necessary, during the seasonal times you
have identified.
It is the intent of our project that the average concentration of lead (Pb) and other heavy metals in the
exposed waste rock remaining on-surface that will be exposed to game animals will be reduced by as
much as 50% in our project area within 3 years of starting the project. This is a significant benefit that
should be considered in assessing and balancing the short-term potential impacts to the long-term
benefits of this project. See Environmental Pollution Vol. 157, Issue 4,April 2009, pgs 1388-1395 for
citation in the literature supporting this benefit.
https://www.scienced i rect.com/science/article/abs/pii/S026974910800657X
I appreciate the opportunity to fully confer with your team and to address these concerns and balance the
short-term costs and long-term benefits of this project. Please let me know if I can provide any further
information, or if we can discuss this with your team to develop other mitigations to the concerns
identified.
Thank you for your consideration.
Sincerely,
Joseph G. Harrington
President, MineWater LLC
Manager, MW Sorter LLC
720.883.6700
Sent from my iPad
---------- Forwarded message--------
From: Hamous-Miller-DNR, Lexi <lexi.hamous-miller@state.co.us>
Date: Thu, Jul 27, 2023 at 10:11 AM
Subject: Re: Notice of Application Consideration for Permit: M2023015
To: <elliott.russell@state.co.us>
Cc: Marette-DNR, Brandon <brandon.marette@state.co.us>, Tyler Stoltzfus- DNR
<tyler.stoltzfus@state.co.us>
Hello Elliott,
I am attaching CPW's comments for this project to this email.
