USDA United States Forest South Park Ranger District PO Box 219
Department of Service 320 US Highway 285
_ Agriculture Fairplay,CO 80440
719-836-2031
Fax: 719-836-3875
File Code: 2810
Date: August 16, 2023
Mr. Johnny Tonko
Claimant/Operator
4049 North Peakview Drive
Pueblo, CO 81008
Dear Mr. Tonko,
This letter is to acknowledge receipt of your Notice of Intent(NOI) in accordance with the Forest
Service(FS)mining regulations at 36 CFR 228.4(a). Your NOI was received on August 4, 2023,
by the South Park Ranger District of the Pike—San Isabel National Forests& Cimarron and
Comanche National Grasslands(PSICC). The Tonko #1 NOI has been assigned an identification
number of 2810-021210-NOI-2023-013. Please use this number in all future correspondence.
The Tonko Notice NOI outlines your intent to conduct prospecting and exploration operations on
your Tonko#1 unpatented mining claims on the PSICC within the Mosquito Creek watershed in
portions of Sections 7 and 8, T. 9 S., R. 78 W., 6h Principal Meridian, Park County, Colorado. In
your NOI, you propose the following prospecting and maintenance activities:
• Use of existing roads (Park County Road 12 to Park County Road 696)to the private gate
and foot travel to access the Tonko #1 unpatented claim block.
• Use of hand tools including picks, shovels, rock hammers, and metal detectors to
excavate small prospect pits and maintain the claims.
• Operations will occur from September 1 to December 31, 2023.
In reviewing your letter, it has been determined that a Mine Plan of Operations (MPO) is not
needed at this time. An MPO and a reclamation performance bond will be required for my
review and approval if you create significant resource disturbance to surface resources as a
result of proposing or doing any of the following:
• Failing to backfill any holes, pits or trenches.
• Cutting any trees.
• Using mechanized equipment.
• Using roads that are not National Forest System (NFS)roads with mechanized vehicles
(including OHV).
• Creating new access routes or roads.
Jim
Caring for the Land and Serving People Printed on Recycled Paper
