Box 219 Mining and Safety <br /> 320 US Highway 285 <br /> Fairplay, CO 80440 <br /> Re: Request for Deviation to TONKO#1 NOI 2810-021210-NOI-2023-013 Approved <br /> Activities <br /> Dear Mr. Voorhis: <br /> My wife and I traveled to our TONKO#1 mining claim on August 18, 2023, and observed a <br /> "new illegal road"has been recently constructed upon our mining claim ore stockpile. It was <br /> created by tracked heavy equipment that operated to and from the London Mine. This is the <br /> reason I am requesting a deviation to the NOI you approved on August 16, 2023. <br /> We are owners of record, for more than 20 years, of the TONKO #1 Placer Mining Claim serial <br /> number CMC-252344 in Township 9 South, Range 78 West of the 61h Principal Meridian in <br /> sections 7 & 8. Our claim boundaries are adjacent to the land identified by the applicant of a <br /> stockpile processing project. Additionally, in contrary to existing law and long-standing mining <br /> practices, no notice was given to us as required for the 1 l Od Hard Rock Reclamation application <br /> submitted by MineWater LLC and/or MW Sorter LLC. Likewise, I didn't see any reference to a <br /> notice being given to you at the USFS when I reviewed their application through the DRMS <br /> filings. <br /> The illegal construction activities onto our mining claim, appears to me, as being designed to <br /> provide access to my family's ore stockpile by the adjacent mining operations of London Mine. <br /> I request vehicle access onto this "new illegal road" site immediately to properly determine the <br /> extent of illegal disturbance impacts to my family's TONKO #1 placer mining claim mineral <br /> rights. <br /> 719-251-2621 - 4049 North Peakview Drive - Pueblo, CO 81008 <br /> johnny.tonko@tonkomining.com www.tonkomining.com <br />
