The Division finds that the activities proposed by the applicant would not affect the continued <br /> existence of endangered or threatened species or result in the destruction or adverse <br /> modification of their critical habitats (2.07.6(2)(n)). <br /> 16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br /> this time,August 28, 2023,the operator is current in the payment of reclamation fees required <br /> by 30 CFR Chapter VII, subchapter R(2.07.6(2)(o)). <br /> Section B - Rule 4 <br /> I. Roads <br /> The NHM permit area is transected by three separate county roads: Montrose County 2700 <br /> Road runs north-south through the middle of the permit area, BB Road is oriented east-west <br /> and 5th Street is parallel to BB Road '/z mile south. These roads were disturbed by mining <br /> operations and have since been reconstructed and opened for public use. ERMR <br /> reconstructed the roads to the specifications outlined by Montrose County. Montrose County <br /> has assumed responsibility for the roads which were released from reclamation liability in <br /> SL-17 and removed from the permit in TR-73. Details addressing the various county roads <br /> impacted by operations are provided in Attachment 2.05.3(3)-8 and on Maps 2.05.3(3)-8, -9, <br /> -10 and -13. <br /> Haul Roads <br /> The Lincoln Street Haul Road is the only remaining certified haul road in the permit. It <br /> provides access from Lincoln St. to the facilities area in the south eastern part of the permit. <br /> The plan and profile are provided on Map 2.05.3(3)-8. No alternative criteria or <br /> specifications were used for the Lincoln Street Haul Road and details of its construction can <br /> be found in section 2.05.3(3)-8. <br /> TR-107 approved the Johnson Access Road. This access road was approved to remain as a <br /> permanent feature to provide access from BB Road to Pond 13. This access road crosses <br /> property owned by ERMR north of BB Road in Section 36. The location is provided on Map <br /> 2.05.4-5 <br /> IL Support Facilities <br /> Support facilities are located at the southeastern portion of the permit area. Details of the <br /> various facilities are addressed in Section 2.05.3(3), Subsection 11 of the permit application <br /> package. Facilities include office and storage buildings, equipment shop, and petroleum <br /> storage. Storage of petroleum products is no longer conducted at the mine site, unless via <br /> portable fuel tanks to support reclamation activities. All portable tanks are stored in tanks <br /> with double containment. There are no coal preparation plants, conveyors, or permitted rail <br /> spurs. Coal was loaded into contract haul trucks within the disturbed area and transported <br /> directly to the power plant. A coal storage area was approved with TR-81 to store coal west <br /> of the facilities area for future use at the Nucla Power Plant. <br /> 22 <br />
