Main St Trinidad, CO 81082-5002 Re: New Elk Mine (Permit No. C-1981-012) Permit Renewal Application No. 8 (RN-8) Dear Sir or Madam: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on August 31, 2023, an application to renew an existing permit to conduct coal mining operations at the New Elk Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. The applicant, New Elk Coal Company, LLC, proposes to continue underground coal mining operations on land located approximately 25 mile(s) West of Trinidad, Colorado. There are no proposed revisions to the approved mining and reclamation plan, nor is there any proposed surface disturbance outside of the currently approved disturbance area. The permit area is further described as follows: Township 33 South, Range 68 West, in sections 13, 14, 21, 22, 23, 24, 25, 26, and 27. A reclaimed vent shaft is located in Township 33 South, Range 67 West, in Section 19. These sections can be located on the USGS 7.5 minute Vigil and Weston quadrangle maps. The Jansen Loadout is also part of Permit C-1981-012 and is approximately 2 miles west of Trinidad, Colorado in Township 33 South, Range 64 West, in sections 22 and 27. These sections can be located on the USGS 7.5 minute Trinidad quadrangle map. The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle map(s): Vigil, Weston, Trinidad. New Elk Coal Company is requesting to renew permit C-1981-012 for another five year permit term. This renewal application does not propose revisions to the approved mining and reclamation plan, nor is there any proposed surface disturbance outside of the currently approved disturbance area.
