TONKO g Company,
Minin Com an Inc.
Johnny F. Tonko
President
RECEIVED
Certified Mail
AUG 2 9 2023
August 27,2023
DIVISION OF RECLAMATION
Colorado Division of Reclamation, Mining and Safety MINING AND SAFETY
1313 Sherman Street
Room 215
Denver, CO 80203
Re: London Mine, File No. M-2023-015, Reclamation Permit Application
Dear Colorado Division of Reclamation, Mining and Safety:
A couple of weeks ago, my wife and I saw a news release on an Australian Stock Exchage
website that detailed a gold ore Stockpile Processing Agreement with entities located in
Colorado and Australia. We were concerned as that news release had identified our TONKO#1
mining claim stockpile as a target for their processing plan. Attached is an overlay image I
created by projecting our claim boundaries onto the ASX project map.
We traveled to our TONKO#1 mining claim on August 18,2023, and observed a new road has
been constructed upon our stockpile. It was created by tracked heavy equipment that operated
from the London Mine. We photographed the road and stockpile disturbances, and 3 photos are
attached.
I reviewed the London Mine File No.M-2023-015 on the DRMS document website. The
application process has no mention of the processing of our stockpile. We are owners of record
for the TONKO#1 Placer Mining Claim serial number CMC-252344 in Township 9 South,
Range 78 West of the 6`h Principal Meridian in sections 7 & 8. Our claim boundaries are within
200 feet of the affected land and well known to the applicant. No notice was given to us as
required for the 1 I0d Hard Rock Reclamation application submitted by MineWater LLC and/or
MW Sorter LLC.
We have been in contact with the District Ranger Joshua Voorhis and Geologist Amy
Titterington of the United States Department of Agriculture, Forest Service, South Park Ranger
District located at 320 Highway 285, P.O. Box 219 in Fairplay, Colorado 80440.
