Aggregate shall have the right to make such improvements and take <br /> such other actions with respect to the Combined Properties which <br /> are reasonably necessary for the use and operations permitted <br /> under this Second Amended Lease. <br /> d. Aggregate shall have no obligation to explore, extract, mine, <br /> excavate, process, stockpile, remove or sell any materials or <br /> minerals other than sand and gravel. <br /> 18. Restrictions on Use of Bigelow Proper . Aggregate shall not: <br /> a. Remove any top soil or overburden from the Bigelow Property, <br /> which top soil and overburden shall be stripped, stockpiled on the <br /> Bigelow Property and used in connection with the reclamation of <br /> the Bigelow Property and the improvements to the fifteen (15) acre <br /> parcel depicted on Exhibit A-2 hereto; <br /> b. Stockpile any materials mined elsewhere than on the Bigelow <br /> Property, except small amounts of materials at conveyor transfer <br /> points which are being conveyed across the Combined Properties; <br /> C. Operate an asphalt or concrete batch plant or other aggregate <br /> processing operation on the Bigelow Property except fresh water <br /> ponds for processing fines; and except for conveyance of fines, and <br /> the accompanying pipeline to be used in reclaiming this Property; <br /> 19. Restrictions on Use of Landfill Property and Donation Property.Aggregate <br /> shall not: <br /> a. Other than allowed by the First Amendment, remove any top soil or <br /> overburden from either the Landfill Property or the Donation <br /> Property, which top soil and overburden shall be stripped, <br /> stockpiled on the respective Property and used in connection with <br /> the reclamation of the Landfill Property or Donation Property; <br /> b. Stockpile any materials mined elsewhere, other than on the Landfill <br /> Property or the Donation Property, except small amounts of <br /> materials at conveyor transfer points which are being conveyed <br /> across those Properties; <br /> C.
