Aggregate has completed mining any remaining sand, gravel and <br /> gold on the Donation Property, including the additional ten (io) <br /> acres in the northwest portion thereof which Aggregate permitted <br /> for mining pursuant to the Integrated Plan. <br /> 32. Distel Option Property/Distel Plant Site. Subject to the provisions of the <br /> Distel Option Contract, and at the option of Longmont, Aggregate shall convey to <br /> Longmont certain real property ("Distel Option Property"), which Distel Option <br /> Contract provides for a sales price of Ten Thousand Dollars ($10,000.00) per acre, <br /> subject to the two and one-half percent (2.50%) annual increase commencing on <br /> January 1, 2001, and an option period through December 31, 2019. <br /> a. Longmont may purchase the Distel Property over a period not to <br /> exceed 15 years beginning with the year of exercising the option on <br /> or before December 31, 2019; <br /> b. Pursuant to the Option Agreement, Aggregate shall be entitled to <br /> lease back the Distel Option Property for its sand and gravel <br /> processing operations at the Distel Plant Site until December 31, <br /> 2028, and Aggregate shall be entitled under such lease to exclude <br /> the general public from that site as long as on-site operations <br /> continue; and, <br /> C. Aggregate shall be entitled to additional one-year extensions until <br /> December 31, 2033, subject to the performance provisions of <br /> Section 29 of this Agreement. <br /> d. If existing Weld County zoning will not allow the processing of the <br /> off-site Irwin/Thomas Mine material,Aggregate may apply to annex <br /> the property to Longmont, and any annexation shall be subject to <br /> the decision of the Longmont City Council. <br /> e. Subsequent to 2013, and within one year of a written request from <br /> Longmont,Aggregate shall move the Distel Plant Site stockpiles to a <br /> location shown on Exhibit L, to allow Longmont to construct the <br /> extension of the St.Wain Greenway Trail, as shown on this Exhibit. <br /> f. Stockpiles of mining materials shall be relocated from the north <br /> boundary of the Plant Site to an area south of the berm to be <br /> constructed by Aggregate and as indicated on Exhibit L. <br /> g. Mining, material stockpiling, and import material from the Tull and <br /> the Irwin/Thomas may be expanded to the south of the plant, and <br /> recycled concrete and recycled asphalt processing and stockpiling <br /> will be relocated to east of the plant,all as indicated on Exhibit L. <br /> h.
