New Horizon Mine (Permit No. C-1981-008)

Dear Sir or Madam:

The Colorado Division of Reclamation, Mining and Safety is proposing to approve a renewal application for
coal mining and reclamation permit. The application was submitted by Elk Ridge Mining and Reclamation,
LLC on November 22, 2022 for the New Horizon Mine. In accordance with Rule 2.08.5(3)(b) of the Rules
and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, we are providing notice
of this proposed decision.

Any person with an interest which may be adversely affected by the proposed decision may request a formal
hearing before the Mined Land Reclamation Board within 30 days of the date following the first publication
of the public notice by the Division in the San Miguel Basin Forum.

The surface mine is located approximately 1.7 miles Northwest of Nucla, Colorado. The permit area is further
described as follows:
