The approximately 560-acre project site is <br /> located at 38.26520, -104.4781°, near the City of Pueblo, Pueblo County, Colorado. <br /> Based on available information and a site visit conducted on July 1, 2021, we concur <br /> with your aquatic resource delineation for the site, which consists of approximately 69 <br /> acres of wetlands, 37 acres of streams, 2 acres of ditches, and 5 acres of open water <br /> habitat, as depicted on the enclosed aquatic resource drawing. This letter verifies that <br /> the location and boundaries of wetlands were delineated consistent with the wetland <br /> definition at 33 CFR §328.3(c)(16), the 1987 Corps of Engineers Wetlands Delineation <br /> Manual (Wetlands Research Program Technical Report Y-87-1) and the applicable <br /> regional supplements; and the location and boundaries of non-tidal waters conform with <br /> the ordinary high water mark definition at 33 CFR §328.3(c)(7), Regulatory Guidance <br /> Letter 05-05, and any applicable regional guide. <br /> This verification letter does not constitute a jurisdictional determination (JD). A JD is <br /> not required to process an application for a Department of the Army permit. If you do not <br /> require a JD for the site, your permit application may be processed sooner. You may <br /> request a JD for this site at any time prior to starting work in aquatic resources, <br /> including after a permit decision is made. <br /> The delineation included herein has been conducted to identify the location and <br /> extent of the aquatic resources on the site(s) that are potentially jurisdictional under <br /> Section 404 of the Clean Water Act. This delineation may not be valid for the Wetland <br /> Conservation Provisions of the Food Security Act of 1985, as amended.
