Box 50 <br /> Nucla, Colorado 81424 Nucla, Colorado 81424 <br /> III. Summary of Reclamation and Management <br /> A. General Description <br /> The 0.1 acres for Ditch C15 will remain post mine in its current configuration as a permanent <br /> structure to support surface water conveyance for the landowner to SP2 stock pond. Please refer <br /> to Map 1 for the location of the C15 Ditch area being applied for bond release. Within Permit <br /> No. C-1981-008, Attachment 2.05.3(3)-1 contains all applicable design information for the C15 <br /> ditch, Map 2.05.3(3)-1 provides the location, and Appendix 2.05.3(3)-17 contains the letter from <br /> the property owner requesting permanent retention post mine of the ditch. <br /> The 1.7 acres for SP2 stock pond being applied for release under this application was constructed <br /> in 2020 and will remain post mine as a permanent structure. Please refer Map 1 for the area <br /> being applied for bond release. Attachment 2.05.3(3)-39 in Permit No. C-1981-008 contains all <br /> applicable information for the SP2 stock pond including the as-built configuration and the letter <br /> from the property owner requesting SP2 remain as a permanent feature. Appendix B contains a <br /> copy of the approved Livestock Tank Application for SP2 from the Colorado Division of Water <br /> Resources. <br /> The ten-year minimum bond liability period is not required for a stock pond and retained <br /> permanent ditch as described in Rule 3.03.1(5). <br /> B. Topsoil Replacement <br /> The applicability of Rule 4.06.4 does not apply to a post mine stock pond or a permanent ditch. <br /> C. Revegetation Success Demonstration <br /> For SP2 as shown in Appendix D, five cover samples collected by Cedar Creek Associates Inc., <br /> the total ground cover for SP2 is 46.6%with perennial cover comprising 13.8%. It is typical for <br /> annual species to establish in the first year of reclamation and diminish over time. Given this, in <br /> accordance with Rule 3.03.1(5), the revegetation for SP2 has established, is adequate to control <br /> erosion, and is similar to other reclaimed areas at New Horizon Mine and the adjacent <br /> undisturbed areas. <br /> 'Elk Ridge Mining and Reclamation,LLC is the mine permittee and an adjacent surface landowner. A letter was not <br /> sent to Elk Ridge Mining and Reclamation,LLC since it is the applicant also. <br /> SL-26 Page 3 <br />
