No bald <br /> Present eagles present in area of former nest. <br /> The nest has been documented as unoccupied in 2019, 2020,and 2021. Per the CPW monitoring data,the <br /> nest was documented "gone/destroyed" on February 6, 2022. ERC observation in January 2023 also <br /> confirmed the nest has been destroyed and the nest area remains unoccupied. A second nest is depicted <br /> 0.68-mile northeast of the destroyed nest(Figure 3).This second nest is outside the survey area boundary <br /> and both the %-mile and %-mile protective buffer zones do not encroach upon the survey area and will <br /> not be impacted due to the proposed project. <br /> The CPW recommended guidelines (CPW 2020) only consider a nest active when it is "frequented or <br /> occupied by a raptor during the breeding season, or which has been occupied in any of the five previous <br /> breeding seasons." Information regarding destroyed nests is not available within the CPW recommended <br /> guidelines. The nest site adjacent to the survey area is considered destroyed and inactive as there has <br /> been no nesting activity for 5 consecutive breeding seasons (2019, 2020, 2021, 2022, 2023). Therefore <br /> the nest site and survey area is not subject to CPW recommended protective buffer zones. <br /> Figure 3 below depicts CPW-provided nest location and status as of February 6, 2022. <br /> 9 <br />
