Summary
The Review Process
Twentymile Coal (TC), a subsidiary of Peabody Investments Corporation, submitted a permit
renewal application (RN-08)for the Foidel Creek Mine. The Foidel Creek Mine is exclusively
an underground coal mining operation located approximately 22 miles southwest of Steamboat
Springs, Colorado in Routt County. Permit No. C-82-056 was issued on May 23, 1983, and has
been renewed every five years since that date.
For the current renewal RN-08, the Division notified TC by letter on August 1, 2022 that its
permit for the Foidel Creek Mine would expire on May 23, 2023. The letter explained that, for
operations to continue beyond that date, Section 2.08.5(3)(f)requires an application for renewal
to be received on or before November 24, 2022. TC submitted a renewal application on
November 17, 2022 and the application was found complete on November 18, 2022. TC
published a notice of the application in the Steamboat Pilot, four consecutive weeks from
December 1, 2022 through December 22, 2023.
No objections regarding the application were received. The applicant violator system (AVS)was
queried on December 14 2022, and resulted in a recommendation to approve this renewal. The
applicant violator system (AVS)was queried again on August 2, 2023, and resulted in a
recommendation to approve this renewal.
On January 10, 2023, the Division sent an adequacy letter to TC requesting additional
information with regards to portions of the permit. TC provided partial responses to the
Division's adequacy letter in a letter received May 31, 2023. The Division sent a second
adequacy letter to TC requesting additional information with regards to portions of the permit on
June 9, 2023. TC provided responses to the Division's adequacy letter in a letter received July
18, 2023. The Division updated the Reclamation Cost Estimate on January 12, 2023 and
incorporated revisions through issuance date 10/25/2022 (MR322). All adequacy concerns have
been resolved; therefore, the Division proposes to approve the renewal application.
Publication of this proposed decision initiates a thirty-day public comment period. Provided there
are no objections to the decision, the proposed decision will become final at the close of the
comment period.
Foidel Creek Mine 4 August 4,2023
