Summary <br /> The Review Process <br /> Hayden Gulch Terminal, LLC (HGT), a subsidiary of Peabody Investments Corporation, <br /> submitted a permit renewal application (RN-6)for the Hayden Gulch Loadout(Loadout). The <br /> Loadout was originally part of the Hayden Gulch Mine (CDRMS Permit No. C-1980- 003), <br /> located approximately seven miles southeast of the current Loadout boundary. The permit for the <br /> Hayden Gulch Mine was terminated on October 23, 2006. The Loadout was exclusively a coal <br /> loadout facility located approximately 2 miles south of Hayden, Colorado in Routt County. <br /> Permit No. C- 1992- 081 was issued on May 22, 1993, and has been renewed every five years <br /> since that date. <br /> For the current renewal RN-6, the Division notified HGT by letter on August 1, 2022 that its <br /> permit for the Loadout would expire on May 22, 2023. The letter explained that for operations to <br /> continue beyond that date, Section 2.08.5(3)(f)requires an application for renewal to be received <br /> 180 days prior to its expiration date. HGT submitted a renewal application on November 18, <br /> 2022 and the application was found complete on November 28, 2022. HGT published a notice of <br /> the application in the Steamboat Pilot, four consecutive weeks from December 1 through <br /> December 22, 2023. <br /> No objections regarding the application were received. <br /> The Office of Surface Mining's applicant violator system (AVS)was queried on December 14, <br /> 2022 and the recommendation of the system was to provide ownership and control updates. The <br /> applicant violator system (AVS)was queried again on August 2, 2023 using updated ownership <br /> and control information and resulted in a recommendation to approve this renewal. <br /> On January 3, 2023, the Division sent an adequacy letter to HGT requesting additional <br /> information with regards to portions of the permit. HGT provided responses to the Division's <br /> adequacy letter in a letter received by the Division on May 31, 2023. The Division updated the <br /> Reclamation Cost Estimate on December 22, 2022 with MT-6 and incorporated revisions <br /> through issuance date 2/18/2022 (SL2). All adequacy concerns have been resolved; therefore, the <br /> Division proposes to approve the renewal application. <br /> Publication of this proposed decision initiates a thirty-day public comment period. Provided <br /> there are no objections to the decision, the proposed decision will become final at the close of the <br /> comment period. <br /> 3 <br />
