reflects the Division's projection of reclamation costs for the worst-case disturbance that <br /> will occur during this permit term. It reflects one bond release for reclamation work <br /> completed (SL-02). Or Hayden Gulch Terminal, LLC must submit an additional <br /> $143,210.00 performance bond due to the Division within 30 days of the date of receipt of <br /> this letter(2.07.6(2)(j)). Otherwise, please provide the Division with a reason the increase <br /> is not warranted. <br /> 11. The Division has made a negative determination for the presence of prime farmland within <br /> the permit area. The decision was based on a letter from the Soil Conservation Service that <br /> demonstrates that no prime farmland mapping units are found within the permit area. This <br /> letter is dated April 13, 1978 and can be found in Volume 1, Tab 9, Attachment 9- 3 of the <br /> PAP (2.07.6(2)(k)). <br /> 12. Based on information provided in the application, the Division has determined that alluvial <br /> valley floors exist within or adjacent to the permit area. The alluvial valley floors are <br /> known as the Dry Creek and Sage Creek Alluvial Valley Floors (2.07.6(2)(k) and 16 2. 06. <br /> 8(3)(c)). For additional information concerning the presence of alluvial valley floors along <br /> Dry Creek and Sage Creek, please see Volume 1, Tab 7 of the PAP and Section B, Item <br /> XIV of this document. <br /> 13. The Division hereby approves the post-mining land uses proposed for this operation. It <br /> was determined that the proposed postmining land uses, grazing lands (consisting of <br /> dryland pasture, improved pasture, and rangeland), wildlife habitat, and cropland meet the <br /> requirements of Rule 4. 16 for the permit area (2. 07. 6(2)(1)). <br /> 14. Both the Colorado Parks and Wildlife and the United States Fish and Wildlife Service <br /> USFW S)were notified of this Permit Renewal No. 6. Their comments were requested <br /> regarding potential impacts to threatened and endangered species. Response was received <br /> December 12, 2022. No response was received. <br /> The Division finds that the activities proposed by the applicant would not affect the <br /> continued existence of endangered or threatened species or result in the destruction or <br /> adverse modification of their critical habitats (2. 07. 6(2)(n)). Please refer to Section B, <br /> Item XII of this document for details. <br /> 15. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br /> this time, Hayden Gulch Terminal, LLC, the operator, is current in the payment of <br /> reclamation fees required by 30 CFR Chapter VII, subchapter R(2.07.6(2)(0)). <br /> 16. Specific approvals have been granted or are proposed. These approvals are addressed in <br /> the following section, Section B.
