Box 68 <br /> Empire, CO 80438 <br /> Phone(303)569-3221 <br /> July 13, 2023 <br /> Sent Via ePermitting <br /> Mr. Peter Hays <br /> Division of Reclamation Mining and Safety <br /> 1313 Sherman St., Rm. 215 <br /> Denver, CO 80203 <br /> RE: Climax Molybdenum Company, Henderson Operations, Permit No. M-1977-342, <br /> Amendment AM-08 Adequacy Review Response <br /> Dear Mr. Hays: <br /> Climax Molybdenum Company — Henderson Operations is providing this response to the DRMS' July 5, <br /> 2023 Adequacy Review to Henderson's Mining and Reclamation Permit No. M-1977-342 Amendment 8 <br /> application.As described in the enclosed DRMS adequacy review letter,there were no inadequacies, public <br /> notice requirements have been met and there were no objections received by the DRMS during the public <br /> comment period.The Division of Water Resources(DWR), United State Army Corps of Engineers(USACE) <br /> and History Colorado provided comments generally requesting that applicable laws and regulations be <br /> followed. Henderson acknowledges receipt of these comments, is committed to following all required laws <br /> and regulations, and provides the following responses to comments from each of these agencies: <br /> • DWR: Henderson will submit required Notices of Intent to Construct Monitoring Holes and <br /> Monitoring/Observation Well Permit Applications for the new monitoring wells and will continue to <br /> operate under the current augmentation plan in Case No. 98CW398. <br /> • USACE: The project does not involve the discharge of dredged or fill material to areas that could <br /> be considered waters of the United States. If the project changes in such a manner that a discharge <br /> of dredged or fill material to waters of the U.S. may occur, Henderson will consider the need for <br /> authorization under Section 404 at that time. <br /> • History Colorado: If any cultural resources are encountered during ground disturbing activities, <br /> including those of human remains, applicable requirements will be followed. <br /> Proof of submittal of this adequacy review response to Clear Creek and Grand counties is also enclosed. <br /> Regards, <br /> Miguel Hamarat <br /> Environmental Manager <br /> Henderson Operations <br /> Climax Molybdenum Company <br /> Enclosures: <br /> 1.
