-1COLORADO <br /> 6 Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> July 12, 2023 <br /> Marcus Mortensen <br /> Mortensen's Landscape and Irrigation <br /> 5868 CR 106 South <br /> Alamosa, Colorado 81101 <br /> RE: Peat Mine, Permit No. M-1994-081, Incomplete Application for Transfer of Mineral Permit <br /> and Succession of Operators, Revision SO-01 <br /> Dear Mr. Mortensen, <br /> On July 6, 2023 the Division of Reclamation, Mining and Safety received the Application Form <br /> for Transfer of Mineral Permit and Succession of Operators from Mortensen's Landscape & <br /> Irrigation, for the Peat Mine, Permit M-1994-081. The following items are incomplete for the <br /> application to be processed: <br /> Legal Right of Enter <br /> 1. No documentation from the Prospective Applicant was provided with the application <br /> providing the Division with proof of the legal right to enter the property. Please provide <br /> documentation in the form of a deed for the land containing the permitted area or a <br /> lease agreement. <br /> Structure Agreement <br /> 2. No structure agreements were submitted with the application by the Prospective <br /> Applicant. The Prospective Applicant must notify any structure owners within 200 feet <br /> of the affected boundary of the permit. This may include roads, buildings, oil and gas <br /> wells, and developed water resources (Such as stock ponds, irrigation canals and wells). <br /> Owners of these structures must be notified via certified mail or provide the Division <br /> with a signed and notarized affidavit containing the structure owner's signature. The <br /> certified mail receipts or signed affidavits must then be provided with the Succession of <br /> Operators application. <br /> Please return the required documentation to the Division before September 10, 2023. All <br /> completed permit documents are required to be submitted for consideration of your Request <br /> for Transfer of Mineral Permit and Succession of Operators Application.
