Scott attempted to obtain a response from CDOT regarding an updated Structures <br /> Agreement. A copy of the email communications is included in Attachment B. The Westbound <br /> Wildlife fence was included in the amended/revised structure agreement request. <br /> Copies of the certified mail receipts for the other non-Scott owned permanent structures are <br /> also included in Attachment B. <br /> We understand that for all structure agreements(Rule 6.4.19(a])proof that a structure <br /> agreement was sent and an attempt to get a completed agreement was made needs to be <br /> provided to the Division. <br /> See the revised Geotechnical Stability Report(dated June 22,2023)included in Attachment C <br /> of the revised narrative. The table on page 5 includes a list of the permanent structures for <br /> which the stability analysis included. <br /> 40. Include a statement that all other permanent man-made structures within 200 ft. of the <br /> affected lands for which a Structure Agreement or Engineering Evaluation have not been <br /> provided are owned by the Applicant. <br /> Section 4.1 has been updated to include a revised narrative stating that all other permanent <br /> man-made structures within 200 ft. of the affected lands for which a Structure Agreement or <br /> Engineering Evaluation have not been provided are owned by Scott. <br /> 41. Pursuant to 6.4.19(b) provide documentation that an attempt was made to obtain a <br /> completed agreement, prior completing the engineering evaluation. <br /> The communications to the permanent structure owners, including certified mail receipts are <br /> included in Attachment a of the narrative. <br /> 6.5 Geotechnical Stability Exhibit <br /> 42. Section 1.1 states that "Our analysis was conducted....for Hard Rock, Metal and <br /> Designated Mining Operations."This is a Construction Materials permit application and <br /> subject to C.R.S. § 34-32.5- 101 et seq. not Hard Rock C.R.S. § 34-32-101 et seq. Please <br /> correct this statement. <br /> Section 1.1 has been revised to correct the above referenced statement. See the revised <br /> Geotechnical Stability Report(dated June 26, 2023)included in Attachment C of the revised <br /> narrative. <br /> 43. Section 3.0 of the Geo-Tech States incorrect information.
