UTALA <br /> C- "M R <br /> 719-539-2521 <br /> Butala Construction Company <br /> 9000 Co Rd 152 <br /> Salida, CO 81201 <br /> June 23, 2023 <br /> Dear Mr. West: <br /> In anticipation of the MLRB Order approving the Stipulated Settlement Agreement <br /> Between the Division of Reclamation, Mining, and Safety and Butala Construction Company, <br /> submitted July 15, 2023 ("Agreement"), and the Cease and Desist Order to be issued pursuant to <br /> Paragraph 33 of the Agreement, we hereby request approval to sell and remove from the Mine <br /> certain materials that have been stockpiled. This material has been segregated into stockpiles as <br /> follows: <br /> • Boulders (greater than 20-inches in diameter) <br /> • Cobble Rock 8—20 inches in diameter <br /> • Cobble Rock 4—8 inches in diameter <br /> • Cobble Rock 2—4 inches in diameter <br /> • Cobble Rock 1 —2 inches in diameter <br /> The rock and gravel materials were mined from the south pit, not from the Mine <br /> Restricted Area. The boulders were mined over a period of about 20 years from various areas <br /> outside of the Mine Restricted Area. In addition, due to the size of these materials, it is not <br /> practical to analyze samples in the laboratory. Jeremy Musson of Pinyon Environmental has <br /> inspected these piles and reports no evidence of polycylic aromatic hydrocarbons, the <br /> contaminants of concern for the Mine Restricted Area. A report from Pinyon Environmental, <br /> which includes photographs and figures depicting the stockpile locations, is attached. Also <br /> attached is a summary of products that are stockpiled and sold at the Mine, with additional <br /> details regarding the mining and processing of the cobble rock that is the subject of this request. <br />
