TR-107 Johnson Access Road.

Dear Sir or Madam:

The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 27, 2023 an
application to revise coal mining operations at the New Horizon Mine was considered complete for
the purposes of filing. The revision was submitted by Elk Ridge Mining and Reclamation, LLC. All
review and comment periods as provided in the Act and the Regulations initiate from this date of
filing.

TR-107 proposes the Johnson Access Road which will provide long-term access from the north side
of BB Road down to the Pond 013 area. The applicant is not proposing additional surface
disturbance outside of the area currently approved for disturbance.

The surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla,
Colorado. The permit area is further described as follows:

Sec 6, T46N, R15W: NE 1/4 NE ¼; W ½ NW ¼ NE ¼; SE ¼;

Sec 1, T46N, R16W: N ½ NE ¼ NE ¼; NW ¼ NE ¼; NW ¼ SE ¼ NE ¼;
NE ¼ NW ¼; N ½ SE ¼ NW ¼
Sec 36, T47N, R16W: SE ¼

The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle
map(s): Nucla.
