EST . . . <br /> EXPEDITIONSL 0 U S Hr , <br /> 5. Following CRS 34-32-113— Prospecting notice. We have complied with all aspects of <br /> this. The exception would be the reclamation fee that was added a reclamation cost of <br /> $6,073 which includes the building of a grated enclosure on the adit. Please note that <br /> you have not allowed us to complete work to the point where a gate could be built on <br /> the adit. <br /> 6. According to CRS 34-32-113, item 5. "Upon completion of the prospecting, there shall be <br /> filed with the board a notice of completion of prospecting operations. Within ninety days <br /> after the filing of the notice of completion, the board shall notify the person who had <br /> conducted the prospecting operations of the steps necessary to reclaim the land." <br /> You have stated that your position is that the presence of iron and rock that was open and in <br /> exposed to the elements for over 100 years, was buried within an open drift. And, that the <br /> disturbance of this material will require extensive capture and testing processes. You have also <br /> stated that to move forward with prospecting, we will need a 110d Mining Permit as an active <br /> Mining operation. Your evidence for any impact of this iron and rock on public health, water <br /> ways does not exist. You have provided no evidence of this danger, nor of the actual deposit. <br /> However, you have utilized this story to stop any prospecting activity. <br /> There are no laws or regulations that even hint at your ability to stop this prospecting activity. <br /> Your requirements are well beyond any legal scope for prospecting operations. <br /> Further these actions go directly against the objectives of the Division of Reclamation, Mining <br /> and Safety, that being to identify and develop mineral resources for the state of Colorado. <br /> Please be aware that it is our intention to take legal action against the DRMS for gross <br /> negligence and wanton disregard in relation to established Colorado State laws and statutes. <br /> As a result of these actions, our company will seek both compensatory and punitive damages. <br /> We intend to conduct an extensive discovery period where we intend to show that the DRMS <br /> has a long history of similar disregard for laws and regulations with other mining and <br /> prospecting operations. <br /> Please be advised that we also intend to prove that the Department of Natural Resources along <br /> with the Department of Reclamation, Mining and Safety have conspired and taken illegal actions <br /> to destroy and remove public access to minerals and mining development by performing <br /> undocumented closures across the state. <br /> A detailed complaint will be filed with the State of Colorado AG, and we are compiling a civil <br /> action as well. <br /> Please consider this a formal complaint and demand for resolution and reparation. <br /> We ask that the Colorado Division of Reclamation, Mining and Safety, and by association, the <br /> Division of Natural Resources, comply with the existing laws post haste and remove all <br /> impediments to our current prospecting operation.
