BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE RECONSIDERATION OF APPROVAL OF 110(1) <br /> PERMIT APPLICATION OF SSG MINING, LLC DUE TO FAILURE TO <br /> SUBMIT PERFORMANCE AND FINANCIAL WARRANTY WITHIN ONE <br /> YEAR OF APPROVAL, LOMBARD #3; File No. M-2020-057 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> May 17, 2023, for a hearing to reconsider the previous approval of the application of <br /> SSG Mining, LLC ("Applicant") for a 110(1) permit, file number M-2020-057, due to <br /> Applicant's failure to submit performance and financial warranty within one year of <br /> approval. <br /> Peter Hays appeared on behalf of the Division of Reclamation, Mining and <br /> Safety ("Division").' There was no appearance on behalf of Applicant. <br /> The Board, having considered the presentations, testimony, materials <br /> submitted, and being otherwise fully informed of the facts in the matter, enters the <br /> following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division for a 110(1) Limited <br /> Impact reclamation permit for a site known as the Lombard#3 in Clear Creek <br /> County, Colorado (the "Application"). Located in Section 1, Township 3 South, <br /> Range 74 West, 61h Principal Meridian, the Lombard#3 is a proposed .92-acre gold <br /> and silver mine. <br /> 2. There were no objections to the Application filed with the Division, and <br /> the Division approved the Application on October 26, 2021. <br /> 3. The Division set the financial warranty for the site at $14,000. The <br /> financial and performance warranties were due on October 26, 2022. <br /> 4. Under Rule 4.1(2) of the Mineral Rules and Regulations of the <br /> Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated <br /> Mining Operations (the "Rules"), Applicant had one calendar year from the approval <br /> of the Application to submit the financial warranty or the previous approval of the <br /> Application would be reconsidered by the Board. <br /> 1 The Division was staff to the Board on this matter. <br />
