BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF RMR AGGREGATES, INC., CONSIDERATION OF A <br /> STIPULATED AGREEMENT FOR FAILURE TO PROTECT AREAS <br /> OUTSIDE THE AFFECTED LANDS FROM SLIDES OR DAMAGE DURING <br /> MINING OR RECLAMATION, File No. M-1982-121 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> April 19, 2023 in Denver, Colorado and via video conference for consideration of a <br /> Stipulated Agreement between RMR Aggregates, Inc. ("Operator") and the Division <br /> of Reclamation, Mining and Safety ("Division") for failure to protect areas outside <br /> the affected lands from slides or damage during mining or reclamation, file number <br /> M-1982-121. Amy Yeldell and Senior Assistant Attorney General Scott Schultz <br /> appeared on behalf of the Division. Robert Wagner appeared on behalf of Operator. <br /> The Board, having considered the Agreement and having been otherwise fully <br /> informed of the facts in the matter, hereby states that it agrees with and approves <br /> the terms of the Agreement, and orders the following: <br /> FINDINGS OF FACT <br /> 1. This matter concerns a 112c permit for a 38-acre limestone operation <br /> located in Section 36, Township 10 South, Range 89 West, 6th Principal Meridian <br /> near Glenwood Springs, Colorado, permit number M-1982-121. The site is known <br /> as the Mid-Continent LST Mine. <br /> 2. The Board adopts the background facts and findings contained in the <br /> Stipulated Agreement between Operator and the Division. <br /> CONCLUSIONS OF LAW <br /> 3. The Board has jurisdiction over this matter pursuant to the Colorado <br /> Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br /> Title 34, C.R.S. (2022). <br /> ORDER <br /> 4. Based on the foregoing findings of fact and conclusions of law, the Board <br /> approves the Stipulated Agreement. The Stipulated Agreement is attached hereto as <br /> Exhibit 1 and incorporated into this Order. <br />
