Box 535 3737 Highway 133 Somerset, CO 81434 Re: Proposed Decision Permit Renewal Application No. 8 (RN-8) Terror Creek Loadout (Permit No. C-1983-059) Dear Mr. Smith: The Colorado Division of Reclamation, Mining and Safety is proposing to approve a renewal application for coal mining and reclamation permit. The application was submitted by Oxbow Mining, LLC on March 2, 2023 for the Terror Creek Loadout. In accordance with Rule 2.08.5(3)(b) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, we are providing notice of this proposed decision. Any person with an interest which may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board within 30 days of date following the first publication of the public notice by the Division in the Delta County Independent. The loadout mine is located approximately 4 miles Northeast of Paonia, Colorado. The permit area is further described as follows: Portions of Section 15, Township 13 South, Range 91 West of the 6th P.M. Copies of the renewal application are available for public review at the Delta County Clerk and Recorder, 501 Palmer Street, Room 211, Delta, CO 81416.
