Box 7812 <br /> Loveland, CO 80537 <br /> RE: Brownstone Quarry, Permit No. M1997-065, Financial Warranty Increase, Revision No. SI-1 <br /> Dear Mr. Hamilton, <br /> On May 30, 2023 the Division of Reclamation, Mining and Safety (DRMS/Division) increased the current <br /> Financial Warranty for the Brownstone Quarry (M1997-065) to $293,861.00, in accordance with Rule <br /> 4.2.1 of the Mineral Rules and Regulations for the Extraction of Construction Materials. This is an <br /> increase of$23,851.00 from the currently held amount of$270,010.00. <br /> The Division ordered amendment of the current Financial Warranty, or submittal of a new Financial <br /> Warranty reflecting the increase, is due within sixty (60) days from the date of this letter, July 31, 2023. <br /> Failure to post the additional required Financial Warranty within sixty (60) days may result in the <br /> Division pursuing enforcement actions. Enforcement actions may include the assessment of civil <br /> penalties, issuing a cease-and-desist order, permit revocation and find the currently held Financial <br /> Warranty subject to forfeiture. <br /> Please make arrangements with Sara Stevenson-Benn at the Division's Denver office for submittal of <br /> the financial warranty.
