May 26, 2023 <br />Joe Lamanna <br />Ready Mixed Concrete Company, LLC <br />11778 Highway 52 <br />Fort Lupton, CO 80621 <br />Re: Nix Sand & Gravel Mine - File No. M-2001-046 <br />Ready Mixed Concrete Company, LLC <br />Technical Revision (TR-3) <br />Technical Revision - Update map and include slurry wall for freshwater/silt pond <br />Dear Joe Lamanna: <br />On May 24, 2023 the Division of Reclamation, Mining and Safety concluded its review of the <br />Technical Revision application submitted to the Division on May 23, 2023, addressing the following: <br />Update mining plan map, change primary access location to site, and include slurry wall around <br />freshwater and silt pond at end of mining. <br />The decision reached by the Division is: approve. TR3 as submitted is approved, however, only the <br />northern cell of the Nix permit is bonded for slurry wall installation at this time. Groundwater can <br />only be exposed in the north cell area until the permittee provides an appropriate bond revision prior <br />to installation of the southern slurry wall. The freshwater and siltation area is currently bonded to <br />backfill, so groundwater may be exposed in that area at this time, however, the permittee will need to <br />approach DRMS to revise the bond prior to installation of a slurry wall around this area as specified <br />in TR3. <br />The terms of Technical Revision No. 3 approved by the Division are hereby incorporated into Permit <br />No. M-2001-046 . All other conditions and requirements of Permit No. M-2001 -046 remain in full <br />force and effect.
