Everist, Inc. <br /> 7321 E 88th Avenue <br /> Henderson, CO 80640 <br /> Dear Mr. Noteboom: <br /> This letter is in reference to the above-mentioned proposed project located at <br /> approximate latitude 40.225274, longitude -104.858926, in Weld County, Colorado. The <br /> work as described in your submittal consists of the discharge of fill and dredged material <br /> to fill in 2.658 acres of existing ditches and to relocate 0.433 acre of ditch C1. <br /> Based on the information that has been provided, this project meets the criteria <br /> established for the Regional General Permit (RGP) - Ditch Related Activities in the <br /> State of Colorado (RGP-5-DEN). Accordingly, for purposes of Section 404 of the Clean <br /> Water Act (33 USC 1344) and in accordance with 33 CFR 325.5(c) (1), the project is <br /> authorized provided the stipulations, conditions, mitigation requirements and other criteria <br /> of RGP 37 are satisfied. This RGP is valid until July 30, 2024. <br /> Although an Individual Department of the Army permit will not be required for this <br /> work, this does not eliminate the requirement that any other applicable Federal, state, <br /> tribal or local permits be obtained as required. Please be advised that deviations from <br /> the original plans and specifications of this project could require additional authorization <br /> from this office. <br /> The applicant is responsible for all work accomplished in accordance with the terms <br /> and conditions of the Regional General Permit. If a contractor or other authorized <br /> representative will be accomplishing the work authorized by the Regional General <br /> Permit on behalf of the applicant, it is strongly recommended that they be provided a <br /> copy of this letter and the attached conditions so that they are aware of the limitations of <br /> the Regional General Permit. Any activity which fails to comply with all the terms and <br /> conditions of the Regional General Permit will be considered unauthorized and subject <br /> to appropriate enforcement action. <br />
