EXHIBIT S <br /> PERMANENT AND MAN-MADE STRUCTURES(10/11/2022) <br /> Owner (s) of Record of a Structure (s) within 200 feet of the <br /> mine, will receive a letter and Structure Agreement as required <br /> by the Colorado Division of Reclamation, Mining and Safety <br /> (DBMS) . As per the DRMS rules, when a permit application is <br /> filed, the rules require either: <br /> a. The operator/applicant requests a Structure Agreement <br /> with owners of any permanent man-made structures within 200 <br /> feet of the permit area. In the agreement, the operator <br /> agrees to reimburse the structure owner for any damage done <br /> to their structure as a result of the mining operation. OR <br /> b. The operator/applicant can provide the DRMS with a <br /> Geotechnical Stability analysis which demonstrates that any <br /> structures within 200 feet of the permit area shall not be <br /> damaged by mining or reclamation activities occurring at the <br /> above-referenced site. <br /> We are sending letters and Structure Agreements to the Own- <br /> ers of Record for the structures listed in this exhibit and ex- <br /> pect to have some completed in the next 30 to 60 days . Copies of <br /> the completed agreements will be provided to Division when they <br /> are received. <br /> In lieu of receiving agreements from Structure Owners, L.G. <br /> Everist is including a Geotechnical Stability analysis in this <br /> permit application that has been prepared by Deere & Ault . It <br /> shows that the required safety factors are greater than State <br /> requirements at the slurry wall boundary, so the safety factors <br /> for any structure outside the boundary will be well above the <br /> state' s requirements . <br /> This list represents the permanent man-made structures <br /> within 200 feet of or on the new permit area. Some offsite <br /> structures are within 200 feet of the permit area but not within <br /> 200 feet of an area to be mined.
