EVERIST, INC.-WEST FARM RESERVOIR ADEQUACY RESPONSE 01 <br /> MAY 23, 2023 <br /> EXHIBIT M -Other Permits and Licenses (Rule 6.4.13): <br /> Will County permitting be required for future conveyor crossing(s)? <br /> No, this site is located in the Town of Platteville and CR 32.5 is a Town street. When the <br /> annexation agreement was approved in December 2020 the proposed conveyor crossings <br /> and equipment crossings were approved as part of that agreement. When the final <br /> Development Plan is approved LGE will make sure they are included and allowed. <br /> EXHIBIT S - Permanent Man-Made Structures (Rule 6.4.19): <br /> During review of the south line setback, we found that the gas line owned by Snyder Oil <br /> has been abandoned and the north-south section that is west and parallel to the old <br /> railroad embankment was physically removed. In addition, early this month Kerr-McGee <br /> began to plug the north well (West Farm 4-14A) in Phase 3 and will remove it and the <br /> associated gas feeder line. These structures have been removed for all maps or if <br /> abandoned are labeled as such on Map Exhibit C-2 Structures. <br /> Copies of the 3 structure agreement received as of this date are enclosed for the file. <br /> If more are received at a later date they will be provided for the file. <br /> 30) Please make sure that any adjustments made to the setbacks, armoring, and interior pit <br /> sloping methods made to the proposed mining and reclamation plans through the <br /> adequacy process are accurately reflected in the slope stability analysis provided, <br /> and/or provide a discussion as to why the submitted analysis is still valid. <br /> The existing analysis was prepared to show that the Factors of Safety are to the closest <br /> structure, in this case the slurry wall. Since the slurry walls are within the permit area <br /> the FOS for the permit boundary or any structures outside the Slurry walls would be <br /> within the FOS minimums required. Any changes to the setback or the interior pit slopes <br /> would have no impact to the FOS provided in the Slope Analysis. <br /> Additional Information: You will also need to provide the Division with proof of notice <br /> publication as well as proof of notice to surrounding property owners within 200'of the <br /> permit. <br /> Attached are copies of the return receipt cards for the notices to surrounding property <br /> owners within 200' that have been received to date. L.G. Everist, Inc. has not received 3 <br /> return receipts back, so we printed the tracking information for those items and provided <br /> a copy of the mailing receipts for cross reference. <br /> Attached is a copy of the Proof of Publication. <br />
