Syracuse Way, Suite 450 <br /> Greenwood Village, CO 80111 <br /> Dear Mr. Fallin: <br /> On April 14, 2023,the Bureau of Land Management(BLM)received the Rocky Mountain Industrials (RMI) <br /> revised proposed Plan of Operations Modification(BLM serial number: COC-074205)to address non- <br /> compliance issues at the Mid-Continent Quarry in Garfield County, Colorado. <br /> Consistent with the surface management regulations at 43 CFR 3809.411(a),the Bureau of Land <br /> Management(BLM)has reviewed the proposed RMI Plan of Operations Modification and has determined <br /> that it meets the content requirements at 43 CFR 3809.401(b). <br /> While the description of the Plan of Operations Modification is complete,the BLM cannot make a final <br /> decision on the proposed Plan of Operations Modification until it completes the environmental review <br /> required under the National Environmental Policy Act(NEPA). <br /> Per 43 CFR 3809.401(c),BLM requires RMI to supply additional information, including the final <br /> geotechnical report,to enable BLM to analyze potential impacts as required by NEPA, determine whether <br /> your plan will prevent unnecessary or undue degradation, and ensure that your operations comply with 43 <br /> CFR subpart 3809. We will send future correspondence that outlines other information needs based on our <br /> technical review of the Plan of Operations Modification and the final geotechnical report.BLM must receive <br /> this information before we initiate the public scoping process for our environmental review. <br /> Be advised a future step in the review process is for the BLM to solicit public comment on the Plan of <br /> Operations Modification under 43 CFR 3809.411(c), either separate from or as a part of the environmental <br /> review process required by NEPA.
