4 <br /> 4. Processing and Storage. Tenant may process (including the installation of all <br /> necessary equipment to process sand, gravel and aggregate) and store sand, gravel and <br /> aggregate on the Property during the term of this Lease. <br /> 5. Sales Royalty and Annual Advance Minimum Royalty. Tenant shall payLandlord <br /> s <br /> 11 � � I � il � ► ► : <br /> 6. Payment Terms. Tenant shall pay to Landlord all sales royalties due under the terms <br /> of this Lease by the 30th day of each month following the month in which the material has <br /> been sold and removed from the Property. All disbursements shall be made payable jointly <br /> to the individual parties constituting Landlord and shall be mailed to Landlord at 12281 <br /> Colorado State Highway 60,Milliken, Colorado 80543 or at such other address as Landlord <br /> may notify Tenant of in writing. Tenant shall forward to Landlord monthly reports reflecting <br /> the tonnages of overburden, sand,gravel and aggregate sold and removed from the Property <br /> during the preceding month according to load tickets with dates of loading. The reports shall <br /> be mailed to Landlord by the 30th day of the month following any month in which <br /> overburden, sand, gravel, and aggregate are sold and removed from the Property by Tenant. <br /> Tenant shall keep an accurate record of all sales of overburden, sand, gravel and aggregate. <br /> Landlord reserves the right to inspect such records for a period of six (6) months after the <br /> month of sale and removal. <br /> 7. Surface Rights of Tenant. Tenant may clear brush and undergrowth from portions <br /> of the Property as may be reasonably necessary to explore for materials, or to locate pits, <br /> quarries and stockpile areas. In order to obtain access to the Property and to carry on its <br /> operations, Tenant shall have the right to use all roadways now existing on the Property. <br /> Tenant may build additional roads for the production and removal of material. Tenant may <br /> install equipment and machinery necessary or convenient to process and store overburden, <br /> Page 2 of 9 pages <br />
