The revision was submitted by New Elk Coal Company, LLC. All review and
comment periods as provided in the Act and the Regulations initiate from this date of filing.

This revision proposes to reroute the RDA haul road and move the clean water ditch higher up the
canyon so New Elk can continue to access and operate the RDA. The relocation of the haul road
and ditch will disturb an additional 15.9 acres and will take place within the current permit boundary.
The applicant is proposing additional surface disturbance outside of the area currently approved for
disturbance.

The underground coal mining operation is on land located approximately 25 miles West of Trinidad,
Colorado. The permit area is further described as follows:

Township 33 South, Range 68 West, in sections 13, 14, 21, 22, 23, 24, 25, 26, and 27. A reclaimed
vent shaft is located in Township 33 South, Range 67 West, in Section 19. These sections can be
located on the USGS 7.5 minute Vigil and Weston quadrangle maps. The Jansen Loadout is also
part of Permit C-1981-012 and is approximately 2 miles west of Trinidad, Colorado in Township 33
South, Range 64 West, in sections 22 and 27. These sections can be located on the USGS 7.5 minute
Trinidad quadrangle map.

The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle
map(s): Vigil, Weston, Trinidad.
