<br /> <br /> <br /> <br /> <br /> <br />April 21, 2023 <br /> <br /> <br />Phillip Courtney <br />Rocky Mountain Materials and Asphalt, Inc. <br />c/o Martin Marietta Materials, Inc. <br />1627 Cole Boulevard, Suite 200 <br />Lakewood, CO 80401 <br /> <br /> <br />Re: Penrose Ranch’s - File No. M-1992-016 <br /> Rocky Mountain Materials and Asphalt, Inc. <br /> Technical Revision (TR-2) <br /> Update Mine Plan <br /> <br />Dear Phillip Courtney: <br /> <br />On April 21, 2023 the Division of Reclamation, Mining and Safety concluded its review of the <br />Technical Revision application submitted to the Division on March 31, 2023, addressing the <br />following: <br /> <br />Update to mine plan to identify the disturbed area and update the highwall excavation practice <br /> <br />The decision reached by the Division is: approve. <br />Approval of TR-2 reflects an increase to 265 acres of maximum allowed affected area at one time <br />which includes the remaining 86.2 acres of the 105 acres considered reclaimed, but not released with <br />the approval of SR-1. In addition, the maximum allowed length of highwall is now 3,000 feet to be <br />mined near vertical, with an average height of 20 feet. <br /> <br />The terms of Technical Revision No. 2 approved by the Division are hereby incorporated into Permit <br />No. M-1992-016. All other conditions and requirements of Permit No. M-1992-016 remain in full <br />force and effect. <br /> <br />The revised liability amount exceeds the financial warranty currently held (see below), please submit <br />additional bond or a rider to your existing bond that equals or exceeds the Revised Liability. The <br />revision will not be final until the bond is approved by the Division. <br /> <br /> <br />Bond Held: $281,284.00 <br />Prior Liability: $281,283.09 <br />Change in Liability: $1,397,986.91
