Accept and approve Payment Schedule Updates under Section 6 of the Original Contract and modify the <br /> Encumbrance Amount. <br /> b. Accept and approve the Payment Schedule Updates for a Contract Modification Order (on form of <br /> Exhibit G)which impacts the Project Commitment Amount and/or the fiscal year Encumbrance Amount <br /> pursuant to Section 19 of the Original Contract, and modify the Project Commitment Amount and/or <br /> Encumbrance Amount. <br /> 2) REQUIRED PROVISIONS.All Option Letters shall contain the appropriate provisions set forth below: <br /> a. For use with Option 1(a):In accordance with Section 6 of the Original Contract between the State of <br /> Colorado, Colorado Department of Transportation, and Click here to enter text., the State hereby <br /> exercises its option to accept and approve the Payment Schedule Update attached hereto as Attachment <br /> 1 to Option Letter, which is incorporated by reference herein (the"Payment Schedule Update") or to <br /> encumber the balance of the Original Contract's maximum not to exceed price for the final fiscal year <br /> of construction. As of the effective date of this Option Letter, the Payment Schedule attached to the <br /> Original Contract shall be deleted in its entirety and replaced with the attached Payment Schedule Update <br /> and the Encumbrance Amount(as such term in defined in Section 6 of the Original Contract) shall be <br /> increased/decreased by $ amount of change to a new Encumbrance Amount of Insert New $ Amt as <br /> consideration for services/goods ordered under the Contract for fiscal year indicate Fiscal Year.The total <br /> Contract value including all previous amendments,Option Letters,etc.is Insert New$Amt. <br /> b. For use with Option 1(b):In accordance with Section(s) 19 and 6 of the Original Contract between the <br /> State of Colorado,Colorado Department of Transportation,and Click here to enter text.,the State hereby <br /> exercises its option to accept and approve the modified Project Payment Schedule attached hereto as <br /> Attachment 1 to Option Letter, which is incorporated by reference herein (the "Payment Schedule <br /> Update").As of the effective date of this Option Letter,the Payment Schedule attached to the Original <br /> Contract shall be deleted in its entirety and replaced with the attached Payment Schedule Update and <br /> [insert information below and if necessary delete the options not required]: <br /> i. the Project Commitment Amount (Contract Maximum Amount shown on the Signature Cover <br /> Page of the Contract) shall be increased/decreased by $ amount of change to a new Project <br /> Commitment Amount of Insert New$Amt for work ordered under the Contract. <br /> ii. the Encumbrance Amount shown on the Signature Cover Page shall be increased/decreased by$ <br /> amount of change to a new Encumbrance Amount of Insert New $ Amt as consideration for <br /> services/goods ordered under the Contract for fiscal year indicate Fiscal Year.
