BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF REQUEST FOR EXTENSION FOR CONSIDERATION OF <br /> THE PERMIT AMENDMENT APPLICATION OF MARTIN MARIETTA <br /> MATERIALS, INC., File No. M-1977-439 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board")on <br /> January 18, 2023, via video conference as a consent agenda item for a request for an <br /> extension of the deadline for consideration of the permit amendment filed by Martin <br /> Marietta, Inc. {"Applicant"), file number M-1977-439. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and being otherwise fully informed of the facts in the matter, enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. Applicant has a 112(c)permit for a sand and gravel operation located <br /> in Section 33, Township 8 North, Range 69 West, 6th P.M., for a site known as the <br /> Home Office Mine. <br /> 2. Applicant filed a permit amendment application on January 10, 2022 <br /> ("AM4"). <br /> 3. The 365-day review period expired on January 9, 2023. <br /> 4. Applicant has requested an extension beyond the January 9, 2023 <br /> deadline to February 27, 2023 to allow it to provide the Division with ground water <br /> contour maps requested in the Division's latest adequacy review request and to <br /> provide the Division more time to develop the cost estimate for reclamation costs. <br /> 5. The Division does not oppose Operator's request for an extension. <br /> CONCLUSIONS OF LAW <br /> 6. The Board has jurisdiction over this matter pursuant to the Colorado <br /> Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br /> Title 34, C.R.S. (2022). <br />
