Valley's Edge Resource Substitute Water Supply Plan Page 3 of 5 March 24, 2023 Conditions of Approval I hereby approve the proposed SWSP in accordance with section 37-90-137(11), C.R.S. subject to the following conditions: 1. This SWSP is approved with the effective date of November 1, 2022 through October 31, 2023, unless otherwise revoked or superseded by decree. If this plan is not decreed in water court by the SWSP expiration date, a renewal request must be submitted to this office with the statutory fee of $257 no later than August 1. 2023. 2. Well Permit 82057-F has been issued for this pit, and this permit remains valid. The permit covers up to 30 acres of exposed surface area and allows for annual water uses of up to 118.23 acre-feet for evaporation losses, water lost with the mined product, and dust control. Actual depletions cannot exceed these amounts and are limited to those uses specifically approved through this SWSP. 3. The total surface area of the groundwater exposed at the Valley's Edge Resource Gravel Mine must not exceed 17.0 acres during this plan period, which results in a maximum evaporative loss of 49.85 acre-feet. 4. Total consumption at the Valley's Edge Resources Gravel Mine must not exceed the aforementioned amounts unless an amendment is made to this SWSP. 5. Approval of this SWSP is for the purposes stated herein. Additional uses for the water that is the subject of this SWSP will be allowed only if a new SWSP is approved for those additional uses. 6. The downstream substitute supplies can be used when a continuous live surface stream flow exists between the confluence of St. Vrain River and the South Platte River and the point of discharge of the replacement water, and there is no intervening calling water right. 7. The Applicant has proposed to use water available from any other source legally available for augmentation and which can be provided in the amount, at the time, and at the location required to replace out of priority depletions. Additional sources of replacement water in this SWSP may only be used if the Applicant complies with the attached Division One Administration Protocol "Use of Replacement Sources Not Specifically Identified in an SWSP or Augmentation Plan". 8. The Applicant shall provide daily accounting (including, but not limited to depletions, replacement sources, and river calls) on a monthly basis. The accounting must be uploaded to the CDSS Online Reporting Tool within 30 days of the end of the month for which the accounting applies (https://dwr.state.co.us/Tools/reporting). Instructions for using the tool are available on the Division of Water Resources website on the "Services" —> "Data St Information" page under the heading of Online Data Submittal. Accounting and reporting procedures are subject to approval and modification by the Division Engineer. Accounting forms need to identify the WDID number for each structure operating under this SWSP. Additional information regarding accounting requirements can be found in the attached Augmentation Plan Accounting Protocol. NOTE: Monthly accounting, even during the winter non-irrigation season, is required. Applicant shall verify that the entity making replacement has included them on their accounting submitted to our office. In this case, that entity is the City of Aurora. 9. Applicant must follow the attached "Augmentation Plan Accounting" and "Use of Replacement Sources Not Specifically Identified in an SWSP or Augmentation Plan" protocols, or any other applicable protocols, for the operation of this SWSP.
