Valley's Edge Resource Substitute Water Supply Plan Page 3 of 5 <br /> March 24, 2023 <br /> Conditions of Approval <br /> I hereby approve the proposed SWSP in accordance with section 37-90-137(11), C.R.S. subject to the <br /> following conditions: <br /> 1. This SWSP is approved with the effective date of November 1, 2022 through October 31, 2023, <br /> unless otherwise revoked or superseded by decree. If this plan is not decreed in water court by <br /> the SWSP expiration date, a renewal request must be submitted to this office with the <br /> statutory fee of $257 no later than August 1. 2023. <br /> 2. Well Permit 82057-F has been issued for this pit, and this permit remains valid. The permit covers <br /> up to 30 acres of exposed surface area and allows for annual water uses of up to 118.23 acre-feet <br /> for evaporation losses, water lost with the mined product, and dust control. Actual depletions <br /> cannot exceed these amounts and are limited to those uses specifically approved through this <br /> SWSP. <br /> 3. The total surface area of the groundwater exposed at the Valley's Edge Resource Gravel Mine must <br /> not exceed 17.0 acres during this plan period, which results in a maximum evaporative loss of <br /> 49.85 acre-feet. <br /> 4. Total consumption at the Valley's Edge Resources Gravel Mine must not exceed the aforementioned <br /> amounts unless an amendment is made to this SWSP. <br /> 5. Approval of this SWSP is for the purposes stated herein. Additional uses for the water that is the <br /> subject of this SWSP will be allowed only if a new SWSP is approved for those additional uses. <br /> 6. The downstream substitute supplies can be used when a continuous live surface stream flow exists <br /> between the confluence of St. Vrain River and the South Platte River and the point of discharge of <br /> the replacement water, and there is no intervening calling water right. <br /> 7. The Applicant has proposed to use water available from any other source legally available for <br /> augmentation and which can be provided in the amount, at the time, and at the location required <br /> to replace out of priority depletions. Additional sources of replacement water in this SWSP may <br /> only be used if the Applicant complies with the attached Division One Administration Protocol <br /> "Use of Replacement Sources Not Specifically Identified in an SWSP or Augmentation Plan". <br /> 8. The Applicant shall provide daily accounting (including, but not limited to depletions, <br /> replacement sources, and river calls) on a monthly basis. The accounting must be uploaded to the <br /> CDSS Online Reporting Tool within 30 days of the end of the month for which the accounting <br /> applies (https://dwr.state.co.us/Tools/reporting). Instructions for using the tool are available on <br /> the Division of Water Resources website on the "Services" —> "Data St Information" page under the <br /> heading of Online Data Submittal. Accounting and reporting procedures are subject to approval <br /> and modification by the Division Engineer. Accounting forms need to identify the WDID number for <br /> each structure operating under this SWSP. Additional information regarding accounting <br /> requirements can be found in the attached Augmentation Plan Accounting Protocol. NOTE: <br /> Monthly accounting, even during the winter non-irrigation season, is required. <br /> Applicant shall verify that the entity making replacement has included them on their accounting <br /> submitted to our office. In this case, that entity is the City of Aurora. <br /> 9. Applicant must follow the attached "Augmentation Plan Accounting" and "Use of Replacement <br /> Sources Not Specifically Identified in an SWSP or Augmentation Plan" protocols, or any other <br /> applicable protocols, for the operation of this SWSP. <br />
