Topsoil Protection <br /> 25. The Objectors are concerned that the Applicant will remove topsoil and fail to protect <br /> it from erosion. <br /> 26. Construction Materials Rule 3.1.9 requires that mine operators strip and stockpile <br /> topsoil in a location separate from overburden and mineral. Operators must stockpile <br /> topsoil in locations and configurations that minimize erosion,vegetating the <br /> stockpiles as necessary to stabilize the stockpiles. <br /> 27. The Applicant plans to segregate topsoil from overburden and vegetate any stockpiles <br /> that exist for longer than one growing season. The Applicant plans to spray the <br /> stockpiles with water to control dust. It plans to redistribute topsoil at a depth of <br /> approximately sixteen inches on the reservoir shorelines, with contour furrows to <br /> reduce erosion and encourage plant growth. <br /> 28. The weight of the evidence supports the conclusion that the Applicant's plan would <br /> adequately protect topsoil. <br /> 29. These measures satisfy Rule 3.1.9. <br /> Weed Control <br /> 30. The Objectors are concerned that weeds will infest the Applicant's mine site. <br /> 31. Construction Materials Rule 3.1.10(6)requires the Applicant to control all prohibited <br /> noxious weeds. <br /> 32. The Applicant plans to inspect the mine site for noxious weeds at least twice per <br /> month once it has commenced operations. If it finds noxious weeds,it plans to use <br /> 6 <br />
