Brownwood Pit (M-1979-059), Challenger Pit (M-1985-026), <br /> Kirtright Pit (M-1986-123), Gardels Pit (M-2005-033),Bonser Pit (M-2000-156), and Amen Aggregate <br /> Resource Pit(M-2019-025) <br /> Dear Ken and Richard Coulson, <br /> The Colorado Division of Water Resources ("DWR') has notified our office that operations at the above referenced <br /> sites are not replacing depletions to the South Platte River in a timely fashion resulting in injury. Pursuant to C.R.S. <br /> 34-32.5-116(4)(h)and Construction Materials Rule 3.1.6(1)(a),disturbances to the prevailing hydrologic balance of the <br /> affected land and of the surrounding area and to the quantity and quality of water in surface and groundwater systems <br /> both during and after the mining operation and during reclamation shall be minimized by measures including but not <br /> limited to compliance with applicable Colorado water laws and regulations governing injury to existing water rights. <br /> Please provide our office with a description of your plan to comply with DWR requirements and how further injury to <br /> the hydrologic balance shall be minimized.
