(1). <br /> In accordance with Colorado Revised Statutes§ 34-32.5-110 <br /> (5)(a)Any operator conducting an operation under a permit issued under this section who has <br /> held the permit for two consecutive years or more and who subsequently desires to expand it <br /> to a size in excess of the limitation set forth in subsection (1) of this section may request the <br /> conversion of the permit by filing an application for a permit pursuant to subsection (1) of this <br /> section or section 34-32.5-112; except that the applicant need not soppy ,formation, <br /> materials, and other data and undertakings previously supplied, includi` K 0I*al <br /> materials provided to the board during the course of his current opi >~ t sult1 from' <br /> the board's inspections thereof. <br /> Exhibit D of the current 110c approved permit, paragraph 2 states: <br /> "Wildlife Species list: Deer, antelope, coyote, fox, rabbits, doves, pheasant, numerous <br /> raptors, songbirds, and small mammals." <br /> Exhibit D of the current 110c approved permit, paragraph 3 states: <br /> "Endangered/critical species/impacted: No known or endangered species." <br /> Exhibit D of the current 110c approved permit, paragraph 5 states: <br /> "Assessment of impact: Impacts on wildlife are minor as this is a sandy alluvial type deposit <br /> in the floodway of Sand Creek." <br /> Signed: Donald Bogart <br /> As stated in the original permit above, no known or endangered species exist within the <br /> vicinity of the permit boundary. The existing vegetation on the site is suitable for the animal <br /> populations listed above and are frequently observed. <br /> The adjacent properties vary in vegetation from: Conservation Reserve Program grasses,to <br /> wheat fields,to pasture and row crop commodities. <br /> Very little hunting occurs within close proximity of the property. Hunting that does occur is <br /> done primarily by the landowners of those properties.The subject property in no way affects <br /> the migration of any animal species. <br />
