(1). <br /> In accordance with Colorado Revised Statutes § 34-32.5-110 <br /> (5)(a)Any operator conducting an operation under a permit issued under this section who <br /> has held the permit for two consecutive years or more and who subsequently desires to <br /> expand it to a size in excess of the limitation set forth in subsection (1) of this section <br /> may request the conversion of the permit by filing an application for a permit pursuant <br /> to subsection (1) of this section or section 34-32.5-112;except that the applicant need <br /> not supply information,'f`tjo )s, and other data and undertakings previously, <br /> supplied, including any additional materials provided to the board during the course of <br /> his current operation or resulting from the board's inspections thereof. <br /> Exhibit B of the current 110c approved permit, paragraph 2 states: <br /> ...."Mined area is above any ground water,thereby being a dry pit operation." <br /> Signed: Donald Bogart <br /> The Division of Water Resources for the State of Colorado compiled a report entitled: <br /> GROUNDWATER LEVELS <br /> in the <br /> LOST CREEK <br /> DESIGNATED GROUND WATER BASIN <br /> 2018 <br /> The detailed report states on page 1: <br /> South Area: South of Prospect Valley/Hwy 52 to 144th Avenue <br /> • Depth to water generally ranges from 40 to 113 feet. Water levels increased an average of 1.25 feet <br /> between 2017 and 2018. Longer-term comparisons indicate an increase of approximately 8 feet over 5 <br /> years, and an increase of 3.5 feet over 10 years. <br /> As mentioned earlier in Exhibit D, subsection (f) of this document, planned mining depth of the <br /> operation is not anticipated to exceed 30 feet.This allows for a separation of 10 feet between <br /> anticipated mining depth and the shallowest discovery of water table by the Colorado department of <br /> Water Resources. In December 2022, a domestic well was drilled on an area outside the affected area of <br /> this property. Depth to the top of the water table was encountered at 62 feet. Considering the <br /> difference in elevation between the new well and the mineable area of the affected area, a separation <br /> of 12 feet between TD of the mining area and the water table can be established. <br />
