Mining under the current approved 110c permit has demonstrated that the stratum of the <br /> deepest classification of material in the report, (C3 -44 to 80 inches: coarse sand) extends beyond <br /> the 80 inch measurement. During the drilling of a domestic water well on the property in <br /> December 2022, shale was encountered at a depth of 98 feet.The difference in elevation <br /> between the location of the domestic well and the area being mined is a difference of 30 feet. <br /> Adjusting for elevation in the mined area, shale should be encountered at a depth of <br /> approximately 68 feet. Current mining has concentrated on the fine alluvial sand located in the <br /> upper layers of the mineable area, to a depth of approximately 8 feet. <br /> Coarser material, in minute quantities, have also been mined to a depth of approximately 12 <br /> feet below grade. It is not anticipated that any mining will be done below grade in excess of 30 <br /> feet. No overburden was encountered in any of the mining conducted. <br /> In accordance with Colorado Revised Statutes§ 34-32.5-110 <br /> (5)(a)Any operator conducting an operation under a permit issued under this section who has <br /> held the permit for two consecutive years or more and who subsequently desires to expand it to a <br /> size in excess of the limitation set forth in subsection (1)of this section may request the <br /> conversion of the permit by filing an application for a permit pursuant to subsection (1)of this <br /> section or section 34-32.5-112; # o appliC woe ed not'su Oat <br /> and other data and undertakinis pieujosly supplied, including an ad <br /> , 0 <br /> to the board during the course of his "trrent operation or resulting from the board'shsp��•••,•:,•:. <br /> thereof. <br /> Exhibit B of the current 110c approved permit, paragraph 3 states: <br /> "Usable material is near the surface with little or no overburden, is relatively fine grained with <br /> 100% passing a Y2" sieve and is less than eight feet thick. In the existing pit area,the meager <br /> topsoil, less than 3"thick, has been and will be, pushed aside into small mounds by dozer or front <br /> end loader for future replacement.
