(a) (b) Mining Methods and Earthmoving <br /> In accordance with Colorado Revised Statutes § 34-32.5-110 <br /> (5)(a)Any operator conducting an operation under a permit issued under this section who has <br /> held the permit for two consecutive years or more and who subsequently desires to expand it <br /> to a size in excess of the limitation set forth in subsection (1) of this section may request the <br /> conversion of the permit by filing an application for a permit pursuant to subsection (1) of this <br /> section or section 34-32.5-112;except that the applicant need rrd,�„ ply information, <br /> T rials,a her data and undertakings previously supplied, in�j4 any ad�)onal <br /> materials pr' ' 4d to the board during the course of his current op, F <br /> the board's insctions thereof. <br /> Exhibit B of the current 110c approved permit, paragraph 1 states: <br /> "Mining Plan— Mining is being and will be accomplished by surface earthmoving machines, <br /> primarily with a rubber-tired front-end loader dumping into tractor-trailer dump trucks. <br /> Extraction of the dry alluvial material will be less than 30,000 tons per year." <br /> Signed: Donald Bogart <br /> As stated in the current 110c approved permit, earthmoving will be conducted with the use of <br /> surface earthmoving machines. <br /> (c ) Water Diversions and Impoundments <br /> In accordance with Colorado Revised Statutes § 34-32.5-110 <br /> (5)(a)Any operator conducting an operation under a permit issued under this section who has <br /> held the permit for two consecutive years or more and who subsequently desires to expand it <br /> to a size in excess of the limitation set forth in subsection (1) of this section may request the <br /> conversion of the permit by filing an application for a permit pursuant to subsection (1) of this <br /> section or section 34-32.5-112; except that the applicant need not supOy inf6q <br /> materials, and other data and undertakings previously supplied, includi,Cig any, <br /> materials provided to the bt ,y O the course of his current open 4 1 <br /> the board's inspectio r> . . <br /> Exhibit B of the current 110c approved permit, paragraph 2 states: <br /> ..."Mined area is above any ground water,thereby being a dry-pit operation." <br /> The entire mineable area of the property lies within the flood plain of West Sand Creek and <br /> Sand Creek combined. The material of the creek bed is classified as —Ellicott-Glenberg <br /> complex, 0 to 3 percent slopes by the US Department of Agriculture's Natural Resources <br /> Conservation Service. A reference to the soil survey has previously been presented in this <br /> document under Exhibit C,Subsection H—Soils Report. <br /> The permeability and structure of the material does not lend itself to the construction of <br /> diversion or impoundment structures and none exist or are planned. <br />
